Acceptance of Terms By creating an account or accessing the Game, you agree to be bound by these Terms of Service ("Terms") and our [Privacy Policy](/legal/privacy.md). If you do not agree, do not register or use the Game. At account creation you will be asked to check a box confirming you have read and accept these Terms and the Privacy Policy. We record the date and the version identifier (`tosVersion`) at the moment of acceptance. You must affirmatively check that box — pre-checked boxes do not constitute acceptance. --- ## 2. Age Requirement (13+) — COPPA Notice **The Game is intended for users age 13 and older.** We do not knowingly collect personal information from children under 13. If you are under 13, you may not create an account or use the Game. At registration we collect your date of birth and use it to verify you meet the age requirement. If we discover that a user is under 13, we will terminate the account and delete the associated personal data without notice. Parents or guardians who believe a child under 13 has created an account should contact us immediately at [Insert contact email]. We will investigate and delete the account and its data. --- ## 3. Accounts **3.1 Registration.** You must provide a valid date of birth, a username, and a password. You agree to provide accurate information and to keep it current. **3.2 Account security.** You are responsible for maintaining the confidentiality of your password. Notify us immediately of any unauthorized use. **3.3 One account per person.** You may not operate multiple accounts to circumvent bans, age gates, or other restrictions. **3.4 Invite codes.** During the closed beta phase we may require an invite code to register. Invite codes are personal and non-transferable. --- ## 4. User Conduct You agree not to: - Harass, bully, threaten, or harm other players. - Use hate speech, slurs, or targeted abuse in chat. - Exploit bugs or use third-party tools to gain an unfair advantage. - Attempt to access accounts or data that are not yours. - Use the Game in violation of any applicable law. - Sell, trade, or transfer your account or in-game assets for real money outside of authorized mechanisms. We operate a default-on profanity and slur filter on public chat channels. You may report players using the in-game report tool. Violations may result in mutes, temporary suspension, or permanent ban at our sole discretion. --- ## 5. Virtual Currency and Economy In-game currency ("eddies" / `eb`) and items have no real-money value, are not redeemable for cash, and are not transferable outside the Game. We may adjust, reset, or retire virtual items and currency at any time without notice or compensation. --- ## 6. Intellectual Property The Game and all its content (code, artwork, text, sound, world design) are owned by us or our licensors. Third-party assets are used under their respective open-content licenses; see [CREDITS](/credits) for attribution. You are granted a limited, non-exclusive, non-transferable license to access and use the Game for personal, non-commercial entertainment. You may not reproduce, distribute, or create derivative works without our written permission. User-generated content (character names, chat messages) remains yours; by submitting it you grant us a worldwide, royalty-free license to store and display it in connection with the Game. --- ## 7. Data Rights You have the right to: - **Export** a machine-readable copy of your account, character, and chat-log data at any time (Settings → Export My Data). - **Delete** your account at any time (Settings → Delete Account). Deletion is permanent: your account row is removed and the text content of your chat messages is permanently purged (messages become `[deleted]`). Some anonymized metadata (e.g., timestamps) may be retained for audit purposes. See the [Privacy Policy](/legal/privacy.md) for full details on data collection, retention, and your rights. --- ## 8. Termination We may suspend or terminate your account at any time for violation of these Terms. You may close your account at any time via the in-game settings. Upon termination, your license to use the Game ends immediately. --- ## 9. Disclaimers THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF SECURITY VULNERABILITIES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. --- ## 10. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE GAME SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) $100 USD.
